This one-credit course is proposed for the fall semester of 2021 at NTU. It is open to both law students and medical students. The course covers the elements of the malpractice cause of action and the associated cause of action of informed consent. From a comparative standpoint, the course addresses the duty of care, the standard of care, causation, and damages, with close attention to the much-debated effects of law on the promotion of patient safety, on the economics of medical practice, and on end-of-life care. Examples will primarily be drawn from the United States, Taiwan, and Japan, with occasional reference to other code and common-law systems.
